Conroe Probate Court Office

Montgomery County Probate Court No. 1 is the only statutory probate court in the county. It sits in Conroe at the Montgomery County Courthouse. This court has jurisdiction over all probate matters, guardianship cases, mental health proceedings, and ancillary civil matters related to probate. The court handles estates both with and without a will.

County Clerk Mark Turnbull's office serves as clerk of the court. All probate filings go through his office. Attorneys must e-file all cases electronically. Pro se litigants are encouraged to e-file as well, but it is not required for self-represented filers. Non-refundable fees are charged when you submit through the e-file system.

Guardianship cases in Montgomery County must be registered with the Judicial Branch Certification Commission (JBCC) as required by Texas Government Code Chapter 155. This has been required since June 1, 2018. The JBCC registration must be done online per its rules.

Small estates under $75,000 (minus the homestead) may use a Small Estate Affidavit under Section 205. Every heir must sign. You need the death certificate and a full list of assets and debts.
