Georgetown Probate Court Office

The Williamson County Clerk's office is organized into several divisions. These include Clerk of Civil Courts, Clerk of Probate Court, Clerk of Misdemeanor County Courts at Law 1 through 5, and Clerk of Commissioners Court. The records division handles official public records like land recordings, DBAs, liens, and plats. The vital records division covers birth, marriage, and death records.

Probate records in Texas are generally public. Anyone can go to the courthouse and ask to see a file. Some items like Social Security numbers get redacted, and certain medical records may be sealed.

Probate Filing in Georgetown

Under Texas Estates Code Chapter 51, you file probate in the county where the person lived. Georgetown and all of Williamson County file at the courthouse on MLK Street.

Independent administration under Chapter 257 is the standard method. The executor handles things without much court involvement. Muniment of title under Chapter 256 skips the executor entirely. It works when the estate is clean and does not need active management.

When there is no will, the court runs an heirship proceeding under Chapter 304. Small estates under $75,000 (minus the homestead) qualify for a Small Estate Affidavit under Section 205. All heirs sign. A 30-day waiting period applies after the date of death.

E-filing through eFileTexas is mandatory for attorneys. Self-represented filers can file on paper at the clerk's window. Original wills must be delivered in person.
